State Board of Education must establish statewide nutrition standards meeting recognized national standards from the Alliance for a Healthier Generation or National Academy of Sciences, Institute of Medicine by December 2010.

Nutrition standards apply to school meals, a la carte foods and beverages, After School Snack Program items, and all other food and beverage items sold to students during the instructional day (excluding school or birthday celebrations).

Standards shall be implemented in elementary schools by end of 2011-2012 school year, middle schools by end of 2012-2013 school year, and high schools by end of 2013-2014 school year.

Starting in 2013-2014 school year and every three years thereafter, the State Board of Education must review and update nutrition standards to align with national standards and changes to federal law or Dietary Guidelines for Americans.

State Board of Education must provide free educational information about nutrition standards on its website and establish a system for public reporting of implementation inconsistencies.
