NC S13

Creates a separate felony offense (one class higher than underlying offense) for causing injury to a pregnant woman past her twentieth week of pregnancy that results in miscarriage or stillbirth, rather than simply elevating the underlying felony.

Establishes that if the underlying offense is a Class A or Class B1 felony, the separate offense under this section shall be a Class A felony.

Prohibits using a felony conviction under this section as the underlying felony for a charge of felony murder.

Adds "pregnant" as an aggravating factor in felony sentencing cases under G.S. 15A-1340.16(d).

Becomes effective December 1, 2009, and applies to offenses committed on or after that date.
