Removes 23 counties from the list of counties subject to G.S. 115C-37.1, which governs how vacancies in partisan-elected county boards of education are filled by appointment.

Immediately effective removal includes: Alamance, Avery, Beaufort, Buncombe, Burke, Cabarrus, Caldwell, Carteret, Cherokee, Clay, Cleveland, Davidson, Davie, Guilford, Haywood, Henderson, Jackson, Madison, McDowell, Mecklenburg, Moore, Polk, Randolph, Rockingham, Rutherford, Stanly, Stokes, Transylvania, Wake, and Yancey.

Reduces the counties covered by this statute to only those actually electing boards on a partisan basis: Alleghany, Brunswick, Graham, New Hanover, Vance, and Washington.

Implements further reduction effective December 1, 2010, removing Forsyth from the list, leaving only Alleghany, Brunswick, Graham, New Hanover, Vance, and Washington.

Maintains appointment procedures for vacant board seats in remaining counties, including consultation with party executive committees and restrictions on voting eligibility based on district boundaries.
