NC S586

Adds a fourth category of actions requiring filing of notice of pending litigation (lis pendens): actions seeking injunctive relief under G.S. 113A-64.1 or G.S. 113A-65 regarding sedimentation and erosion control for land-disturbing activities subject to Article 4 of Chapter 113A.

Modifies G.S. 1-116(a) to require separate, independent notice to be filed and cross-indexed for the new category of erosion and sedimentation control actions affecting real property.

Expands the existing lis pendens filing requirement which previously applied only to actions affecting title to real property, foreclosure actions, and attachment proceedings.

Becomes effective October 1, 2009, and applies to actions filed on or after that date.
