Makes it unlawful to knowingly and willfully solicit or receive any remuneration (kickbacks, bribes, rebates) in cash or in-kind for referring individuals to providers for services paid by Medicaid.

Makes it unlawful to knowingly and willfully offer or pay any remuneration to induce others to make referrals or to purchase, lease, order, or recommend goods, facilities, services, or items for which Medicaid may pay.

Exempts contracts between the State and public or private agencies where referral is part of the agency's contractual responsibility.

Exempts any conduct specified in federal law 42 U.S.C. § 1320a-7b(b)(3) and related federal regulations.

Becomes effective December 1, 2010, and applies to offenses committed on or after that date.
