H1009 Summary

• Modifies representation on metropolitan sewerage district boards by changing the threshold for cities/towns to appoint three members from having greater population than all other political subdivisions to having more than one-half the combined population of other subdivisions.

• Creates new G.S. 162A-67.5 establishing that population determinations for board representation use the most recent decennial census and only count population within district boundaries for each political subdivision.

• Prohibits appointments to district boards from political subdivisions that do not own or operate a public wastewater collection system at the time of appointment.

• Specifies procedures for board representation when additional unincorporated areas or political subdivisions are added to existing districts, including detailed requirements for multi-county districts to maintain three members from the county with the largest portion and two from the county with the lesser portion.

• Authorizes metropolitan sewerage districts to exercise any powers held by metropolitan water districts under Article 4 of Chapter 162A not otherwise specified in their own authority.

• Effective July 1, 2012 for all appointments made on or after that date.
