North Carolina Health Care Protection Act (H.B. 2)

• Prohibits laws or rules from compelling any person to provide, contract with, or enroll in health care services, medical treatment, or health insurance plans.

• Protects individuals' right to pay directly for lawful health care services without interference from state law or regulation.

• Prevents imposition of penalties, taxes, fees, or fines on persons for choosing or refusing to obtain health care services or health insurance coverage.

• Exempts from these protections certain situations including drug testing, criminal justice supervision, parental/guardian authority over minors, workers' compensation, involuntary mental health commitments, and public health screenings for newborns and children.

• Grants individuals and the North Carolina Attorney General standing to bring legal action to enforce the protections established in this article, effective upon enactment.
