Allows retired members of the Teachers' and State Employees' Retirement System or Local Governmental Employees' Retirement System who remarried before the effective date of Session Law 2010-72 to nominate their new spouse to receive survivor benefits under Option 5.

Applies only to retirees who originally designated a spouse as survivor, whose designated spouse subsequently died, and who then remarried prior to the enactment of S.L. 2010-72.

Requires the nomination of the new spouse to be completed within 90 days of the act's effective date.

Permits survivor retirement benefits to be directed to the new spouse in accordance with G.S. 135-5(g) or G.S. 128-27(g), depending on which retirement system the member belongs to.

Effective upon becoming law; ratified June 15, 2011, and approved June 23, 2011.
