Homeowners associations cannot prohibit water efficiency improvements including rain gardens, cisterns, rain barrels, and devices designed to capture rainwater or reduce irrigation needs.

Homeowners associations cannot prohibit energy efficiency improvements including external sun control devices, shading devices, and shade tree planting intended to reduce summer air conditioning usage.

For covenants registered before October 1, 2011, restrictions only apply if the covenant specifically prohibits the exact water or energy improvement being installed.

For covenants registered on or after October 1, 2011, associations may only prohibit improvements if the restriction lists the specific measures prohibited and the improvement substantially matches a listed restriction.

The act becomes effective October 1, 2011.
