H.B. 302 Summary

• Broadens the licensing exemption for charitable, nonprofit, faith-based adult residential treatment facilities by removing the requirement that they be part of an international organization serving at least 50 countries or limited to serving ages 18-40.

• Maintains that exempt facilities must not receive any federal or State funding and must be religious organizations exempt from federal income tax under Internal Revenue Code section 501(a).

• Extends the sunset date for a pilot program waiver allowing electronic supervision devices as an alternative to overnight staff supervision at mental health facilities for children and adolescents from December 31, 2012 to December 31, 2015.

• Reserves the Division of Health Service Regulation's right to rescind the electronic supervision waiver if outstanding deficiencies related to the devices remain uncorrected at license renewal.

• Effective July 1, 2012.
