Reclassifies marijuana possession penalties based on quantity, creating an infraction for less than one ounce, Class 3 misdemeanor for one to one-and-a-half ounces, Class 1 misdemeanor for one-and-a-half to two ounces, and Class I felony for two ounces or more.

Adjusts hashish penalties to Class 3 misdemeanor for one-twentieth ounce or less, Class 1 misdemeanor for more than one-twentieth but not exceeding three-twentieths ounce, and Class I felony for quantities exceeding three-twentieths ounce.

Maintains that any imprisonment sentence for Class 3 misdemeanor marijuana possession must be suspended and cannot be required as a special condition of probation.

Creates a new expunction procedure allowing individuals convicted of Class 3 misdemeanor marijuana possession before December 1, 2011 to petition for record expungement after two years or completion of probation, whichever is later, if they meet good behavior requirements.

Effective date of December 1, 2011 for all provisions.
