Session Law 2011-294: House Bill 376

• Expands eligibility for retirement plan benefits to include former employees receiving disability benefits whose lump-sum payouts include vacation, bonus, and sick leave (previously only vacation and bonus).

• Changes penalty assessment for employers failing to report reemployed beneficiaries from mandatory to discretionary, and allows penalty reduction to 2% minimum if employer provides clear evidence of inadvertent failure beyond their control.

• Clarifies that members must render no service (including part-time, temporary, substitute, or contractor service) during the month immediately following retirement's effective date for retirement to become effective.

• Requires employers to remit all employer contributions for a member's full military service period when the member returns to work after military leave, pursuant to federal law (38 U.S.C. § 4318(b)(1)).

• Exempts long-term disability recipients who become eligible for unreduced service retirement from the standard six-month waiting period for receiving retirement allowances.
