Municipalities must hold a public hearing before revising electric rates, with notice published in newspapers for two successive weeks stating the proposed revision amount.

Retail electric customers may appear and be heard at the public hearing on proposed rate changes under provisions of G.S. 160A-81.

The North Carolina Eastern Municipal Power Agency (NCEMPA) must hold a public meeting before changing rates, with notice published in newspapers serving member municipalities for two successive weeks.

Rate revision public hearing requirements do not apply when the Local Government Commission requires immediate action or when immediate implementation is necessary due to catastrophic events or contractual/legal obligations.

Effective October 1, 2012, for the 31 named member cities and towns of NCEMPA including Greenville, Rocky Mount, Wilson, Kinston, and others listed in the act.
