Counties may enact ordinances requiring owners of improved real property to place solid waste in specified places or receptacles for county collection and disposal.

Counties may require separation of materials before collection and mandate participation in recycling programs with designated material separation prior to disposal.

Property owners retain ownership of recovered materials until they convey, sell, donate, or transfer them to another party; counties cannot require transfer to the county unless materials are placed in county-owned receptacles or facilities.

Counties may require participation in solid waste collection services provided by the county or contracted providers if the property owner has not already contracted for collection separately.

Counties may charge a fee for solid waste collection services that does not exceed the actual costs of collection.
