Defines "surcharge" as any additional amount imposed at the time of a sales or lease transaction that increases the charge to the buyer or lessee for using a card.

Allows businesses to offer discounts for cash or non-card payments, provided the discount is offered to all prospective buyers.

Classifies violations as unfair and deceptive trade practices under existing North Carolina law.

Exempts units of local government, public hospitals, and public authorities from the surcharge prohibition, allowing them to impose fees to cover credit card processing costs.
