Community colleges in North Carolina may opt out of participation in the William D. Ford Federal Direct Loan Program through adoption of a board of trustees resolution.

The State Board must ensure at least one counselor is available at each college to inform students about federal financial assistance programs, including Pell Grants, HOPE and Lifetime Learning Tax Credits, and the federal direct loan program for participating colleges.

Any institution that declines to participate in the William D. Ford Federal Direct Loan Program may rescind its resolution to rejoin the program, but may not decline participation again.

The act became effective July 1, 2011, and was enacted notwithstanding the Governor's veto.
