Department of Environment and Natural Resources must transfer stormwater management system permits from a condominium or planned community declarant to the unit owners association upon request when common areas have been conveyed to the association and the declarant has sold at least 50% of units or lots to non-declarant owners.

Sanitary district rules may not be more restrictive than or conflict with county requirements or ordinances, with county requirements controlling in case of conflict.

Any person contracting or subcontracting to rent, lease, manage, or dispose of waste from portable toilets must be permitted to operate a septage management firm.

Commission for Public Health must adopt rules consistent with portable toilet permitting requirements by January 1, 2014.

Act became effective upon passage on June 23, 2011.
