HB 8 - Eminent Domain

• Amends North Carolina Constitution to prohibit condemnation of private property except for "public use" (removes "public use or benefit" standard).

• Requires just compensation in all condemnation cases to be determined by jury at the request of any party.

• Submits constitutional amendment to voters for statewide election on November 6, 2012.

• Amendment becomes effective upon certification by State Board of Elections and applies to all takings after certification date.

• Makes conforming statutory changes to G.S. 40A-3 removing "public use or benefit" language and replacing with "public use" in provisions governing condemnation powers of private and public entities.
