Division of Health Service Regulation may waive annual inspections for adult care homes that achieve the highest rating, but must inspect these facilities at least once every two years.

Adult care homes may request informal dispute resolution procedures to challenge cited deficiencies from inspections, with a right to written notification of these procedures.

If an adult care home successfully demonstrates during informal dispute resolution that deficiencies were incorrectly cited, the Division must remove those deficiencies and rescind related enforcement actions.

Failure by the Division to complete informal dispute resolution timely does not delay enforcement actions, and facilities cannot delay enforcement actions based on incomplete dispute resolution.

Act becomes effective October 1, 2011.
