Exempts air emission sources subject to federal emissions requirements (40 C.F.R. Part 61, Part 63, and case-by-case MACT permits under 42 U.S.C. § 7412(j)) from state air toxics emission control standards.

Requires the Department of Environment and Natural Resources to review permit applications for new or modified sources that would increase toxic air pollutant emissions and determine if they present an unacceptable risk to human health.

Authorizes the Department to require permit applications that eliminate unacceptable health risks, with written findings based on modeling, epidemiological studies, monitoring data, or other relevant information, and mandates reporting to the Environmental Review Commission.

Directs the Division of Air Quality to review toxic air pollutant rules and implementation to reduce regulatory burden and increase resource efficiency while maintaining public health protection, with results reported by December 1, 2012.

Requires the Division of Air Quality to submit annual implementation reports to the Environmental Review Commission by December 1 for 2012, 2013, and 2014, including analysis of air toxic emissions changes and air quality impacts.
