Department of Health and Human Services shall conduct a pilot program to provide overnight respite services in 2-4 certified adult day care programs, with at least 2 programs operated by organizations meeting specific national recognition criteria including Robert Wood Johnson Foundation designation and LEED certification.

Overnight respite care limited to maximum 14 consecutive calendar days or 60 total calendar days per participant in a 365-day period, with capacity not exceeding 6 beds per facility.

State shall not fund overnight respite services and pilot programs are ineligible for Medicaid enrollment; participating programs must be exempt from adult care home licensure and Chapter 131E and 122C licensing requirements.

Department of Health and Human Services shall adopt rules establishing minimum health and safety standards for staffing, building specifications, fire safety, sanitation, nutrition, and medication management; Division of Health Service Regulation shall conduct initial inspection and monitoring visits at least every 6 months.

Program Evaluation Division shall report annually to General Assembly on pilot status and provide feasibility assessment by October 1, 2014; act repeals June 1, 2015.
