Senate Bill 532 Summary

• Transfers the Employment Security Commission into the Department of Commerce as the Division of Employment Security (DES), effective November 1, 2011, consolidating employment security functions under direct leadership of the Secretary of Commerce.

• Creates a three-person Board of Review appointed by the Governor to hear appeals on employment security matters, replacing the previous commission structure with one member representing employers, one representing employees, and one representing the public.

• Makes the Division subject to the Administrative Procedures Act (Article 2A of Chapter 150B) for rule-making, requiring all existing rules to be readopted by December 31, 2012, or they expire.

• Reorganizes the Division into two coordinate sections: the Employment Security Section (employment services) and the Employment Insurance Section (unemployment taxation), each with distinct administrative functions.

• Makes conforming changes throughout the General Statutes to replace references to the Employment Security Commission with the Division of Employment Security.
