Prohibits the manufacture, sale, offer for sale, distribution for sale, or distribution for use of reusable food or beverage containers containing bisphenol A (BPA) in North Carolina, effective January 1, 2013.

Defines reusable food or beverage containers as receptacles for storing food or beverages including baby bottles, spill-proof cups, sports bottles, and thermoses, but excludes single-use disposable containers and containers sold at retail already containing contents.

Requires manufacturers replacing BPA with alternative chemicals to use the least toxic alternative and prohibits substitution with EPA-rated carcinogens (A, B, or C) or substances identified as reproductive toxicants causing birth defects or developmental harm.

Authorizes the Department of Health and Human Services to impose administrative penalties of up to $5,000 for first violations and up to $10,000 for additional violations within any 12-month period.

Directs the Commission to adopt rules implementing the article.
