Secretary of the Department of Health and Human Services may transfer psychiatric hospital beds to community facilities without requiring a written memorandum of agreement between the local management entity and facility under specified conditions.

Facility must submit an application to the Certificate of Need Section and commit to serving short-term patients normally placed at State psychiatric hospitals.

Eligible facilities must be providers created under G.S. 131E-17 and located in a single county area authority as defined in G.S. 122C-116.

Legislation became effective upon enactment and expired on December 31, 2011.
