NC S586

Amends Rule 7(b)(4) of the North Carolina Rules of Civil Procedure to allow motions in civil actions to be heard in a different county within the same multicounty judicial district with permission from the senior resident superior court judge or designee.

Requires that motions heard outside the county where the case was filed be heard during a civil session of court, except in emergencies as determined by the senior resident superior court judge or designee.

Removes previous language allowing motions to be heard at regular criminal or criminal priority sessions with presiding judge consent.

Effective October 1, 2011, and applies to motions made on or after that date.

Ratified June 17, 2011, and approved by the Governor on June 27, 2011.
