Exempts third-party owners or operators of small renewable energy facilities (2 megawatts or less) located on a customer's property from being classified as public utilities and from regulation under Chapter 62 of the General Statutes.

Allows third parties to sell electricity directly to customers from on-site renewable energy facilities without being subject to restrictions on sales or utility regulations, provided the facility capacity does not exceed 2 megawatts.

Defines a customer's site to include all contiguous property owned or leased by the customer, regardless of easements, public roads, transportation rights-of-way, or utility rights-of-way that may divide the property.

Authorizes the North Carolina Utilities Commission to adopt rules to implement the section, including options to establish maximum capacity sizes based on customer peak loads, require feasibility studies for facilities of 500 kilowatts or greater, and create pilot projects for non-solar renewable energy facilities.

Effective date of October 1, 2011.
