Allows employers with 51 or more covered employees to request claim information reports from their health insurance providers for their group health plans.

Employers can request 36 months of data from current insurers or 12 months from prior insurers, including aggregate paid claims, premiums, member counts, and individual claims reports for employees exceeding $25,000 in annual claims.

Individual claims reports must use unique identifying codes rather than employee names or personal identifiers, and employers must certify they will comply with HIPAA privacy requirements to receive this information.

Health insurers must provide requested reports within 30 days in written, electronic, or secure web portal format, and are not liable for releasing information in compliance with this law.

Insurers that fail to comply are subject to existing penalty provisions, and reports provided to governmental entities are confidential and not public records; the law becomes effective October 1, 2011.
