Prohibits distribution or sale of rigid plastic containers labeled "degradable," "biodegradable," or "compostable" unless they meet ASTM standard D6400-04 for compostable plastics.

Requires containers meeting compostability standards to display a clear "Not Recyclable, Do Not Recycle" label in identical color, contrast, font, and size as the biodegradability claim.

Exempts compostable containers from the standard molded resin identification code (numbers 1-7) required on other rigid plastic containers.

Appropriates $2,000 to the Department of Environment and Natural Resources for 2012-2013 fiscal year to develop educational resources about the new plastic labeling requirements.

Effective January 1, 2013, protecting North Carolina's recycling industry by preventing degradable plastic additives from contaminating recycled plastic feedstocks.
