Allows repair or replacement of single-family and duplex residential dwellings greater than 5,000 square feet in Currituck County to meet a 60-foot setback (or 30 times the shoreline erosion rate, whichever is greater) instead of standard oceanfront setback requirements if the structure was originally constructed prior to August 11, 2009.

Requires that repaired or replaced structures not exceed the original footprint and must meet the minimum setback requirement under 15A NCAC 07H .0306(a)(2)(A).

Applies only to properties subject to covenants and restrictions minimizing impact of structures in sensitive areas and where owners are members of a property owners association.

Requires the property owners association to have expended at least $1,500,000 for dune restoration and to maintain a dune restoration fund of at least $1,500,000, and must employ a professional coastal engineer and contract with a local dune management service provider.

Applies to Currituck County only and is effective upon enactment.
