Union County authorized to use design-build, design-build-operate, or single-prime contractor methods for constructing law enforcement and human services facilities without compliance with standard public procurement requirements in Articles 3D and 8 of Chapter 143.

Union County may enter into build-to-suit capital leases with private developers for facilities with construction costs exceeding $300,000, with private developers responsible for site selection, design, construction, financing, maintenance, and other services.

Build-to-suit capital leases cannot contain nonsubstitution clauses, and Union County's taxing power cannot be pledged to secure lease obligations or used to satisfy deficiency judgments.

Union County must request proposals from at least five design-build teams or private developers and award contracts based on best value considering qualifications, time, cost, quality, occupancy costs, and other factors deemed relevant by the Board of Commissioners.

The authorization expires five years after the law becomes effective (June 26, 2012).
