Lower Cape Fear Water and Sewer Authority is authorized to use the design-build method of construction for water projects within its service area, notwithstanding existing state procurement statutes.

Authority must prequalify and solicit at least three design-build teams to bid and receive at least three sealed proposals for each project, with proposals not requiring submission of detailed design solutions.

Authority must interview at least two of the design-build teams that submit proposals and award the contract to the best qualified team based on project completion time, compliance with G.S. 143-128.2, and project cost.

Authority may proceed with fewer than three proposals if the project has been publicly advertised for a minimum of 30 days and three proposals are not received.

Act becomes effective upon passage and expires December 31, 2015.
