Allows the Town of Duck to exercise eminent domain power for beach erosion control and flood and hurricane protection works, including acquiring property needed for beach renourishment.

Adds the Town of Duck to the list of coastal municipalities authorized to use eminent domain for these specific coastal protection purposes under G.S. 40A-3(b1)(10).

Grants the Town of Duck immediate possession and title to condemned property upon filing a complaint and making a deposit, rather than waiting for court proceedings to conclude.

Applies only to the Town of Duck and does not include authorization for public beach access provisions that apply to other coastal towns.

Effective upon enactment.
