Transfer responsibility for administering and enforcing existing erosion and sedimentation control plans from the state commission to local governments upon approval of local erosion control programs.

Local government programs must meet or exceed state standards established under G.S. 113A-54 before the commission approves the transfer.

Commission must review submitted programs and notify local governments within 90 days whether the program is approved, approved with modifications, or disapproved.

Transferred responsibility applies to all erosion and sedimentation plans previously approved by the state commission that affect land-disturbing activity within the local government's territorial jurisdiction.

Effective date: October 1, 2014.
