House Bill 1158 Summary

• Amends the City of Morganton charter to change municipal elections from a runoff method to plurality voting as provided in G.S. 163-292.

• Moves election timing from the fourth Tuesday before November to the Tuesday after the first Monday in November of odd-numbered years.

• Revises recall petition procedures to require signatures from 25% of registered voters within 30 days of filing an affidavit with the Board of Elections, with verification within 20 days.

• Prohibits recall elections during the first 12 months and last 12 months of an official's term, and limits each official to one recall election per term.

• Requires officials removed by recall election or who resign after a sufficient recall petition is filed to be ineligible for appointment to fill the resulting vacancy.

• Effective July 1, 2014, for affidavits and petitions filed on or after that date.
