House Bill 180 - Mechanics Liens Technical Corrections

• Clarifies that lien agent designation is required for real property improvements costing $30,000 or more at the time the building permit is issued or, if no permit is required, when the contract is entered into with the owner.

• Adds new delivery method allowing parties to transmit lien agent notices and claims through an approved Internet website with delivery receipt, in addition to existing methods like certified mail, facsimile, and email.

• Simplifies perfection of subcontractor claims of lien on real property by requiring only satisfaction of requirements in G.S. 44A-11 (lien agent notice), rather than multiple conditions related to serving notices on owners and lien agents.

• Establishes fixed fees for lien agent services: $25.00 for one- or two-family dwelling improvements and $50.00 for all other improvements, changing from discretionary fee structure.

• Effective April 1, 2013, with most provisions applying to improvements where labor or materials are first furnished on or after the effective date.
