Department of Health and Human Services must apply to Centers for Medicare and Medicaid Services (CMS) for approval to allow deduction of Department of Veterans Affairs Survivors Pension Benefits from income when determining Medicaid eligibility.

The deduction applies only to Medicaid populations where income is not defined by federal law as modified adjusted gross income.

If CMS approves the policy, the Department shall implement it effective January 1, 2014.

Act becomes effective upon passage.
