Clarifies that the North Carolina State Ports Authority operates within the Department of Transportation but exercises its statutory powers independently of the Secretary of Transportation.

Amends G.S. 136-260(a) to specify the Authority is "administered under the direction and supervision of the Secretary" while maintaining independent exercise of its prescribed statutory powers.

Clarifies the Type II transfer of the State Ports Authority from the Department of Commerce to the Department of Transportation performed under Section 14.6 of S.L. 2011-145.

Prevents the Secretary of Transportation from assuming the statutory authorities and duties that are provided to the Board of the State Ports Authority under Article 20 of Chapter 136 of the General Statutes or other State law.
