H310 - Handgun Permit Modernization Act

• Removes requirement for applicants to submit mental health records and character affidavits, instead relying solely on National Instant Criminal Background Check System (NICS) to determine mental fitness for handgun permit.

• Prohibits sheriffs from requesting information, character affidavits, additional background checks, photographs, or other documents beyond those specifically required by law.

• Establishes 45-day timeline for sheriffs to issue or deny permits after receiving required application materials, removing the prior requirement to wait for mental health records.

• Authorizes temporary permits for up to 45 days in emergency situations (such as protective order holders) upon submission of basic application, fee, and fingerprints only.

• Eliminates fees for permit applications, renewals, duplications, and fingerprint processing beyond standard permit fees authorized by law, effective October 1, 2013.
