H.B. 43 Summary

• Requires ignition interlock systems to be installed on vehicles for all persons convicted of driving while impaired, driving after consuming alcohol while under 21, or who refuse chemical analysis before they can obtain a limited driving privilege.

• Mandates ignition interlock systems be set to prohibit driving with any alcohol concentration greater than 0.00, and requires personal activation by the driver before each use.

• Establishes an Ignition Interlock Device Fund through administrative fees of $30-$60 collected at installation, with 50% funding Division administration and 50% assisting indigent persons unable to pay installation costs.

• Applies the ignition interlock requirement to all registered vehicles owned by the person subject to the restrictions, with limited exceptions for family vehicles not in their possession.

• Effective December 1, 2013, for offenses committed on or after that date.
