Upon motion from a board of county commissioners, the Department of Transportation must evaluate abandoned or unmaintained roadways to determine if they were previously dedicated to the Department.

The Department must investigate whether a roadway is located on right-of-way that was dedicated to and accepted by the Department of Transportation.

If the Department owns the right-of-way, it must add the roadway or portion of roadway to the secondary road system.

The county commissioners' resolution must include findings that a factual issue exists about whether the roadway was historically dedicated to the Department and that landowners or the public have been denied use of the roadway.
