Creates a new offense under G.S. 64-6 prohibiting any person not lawfully present in the United States from possessing a firearm in North Carolina.

Defines "lawfully present" as holding valid U.S. government documentation of legal presence or having been otherwise permitted to remain in the United States by the federal government.

Establishes possession of a firearm by an undocumented person as a Class I Felony.

Authorizes sheriffs and law enforcement officers to seize firearms believed to be unlawfully possessed and retain them pending a court disposition order.

Becomes effective December 1, 2013, and applies only to offenses committed on or after that date.
