County boards of commissioners may remove territory from a service district by resolution if 100% of real property owners in that territory petition for removal.

Removal is only permitted if the territory no longer requires the services provided by the district and the district was created solely to provide specific services listed in state law (G.S. 153A-301(a)(4) or (a)(6)).

The service district must have no outstanding bond obligations or related expenses before territory can be removed.

The board must prepare a report with a map and statement showing the territory meets removal standards, available for public inspection at least 10 days before a public hearing.

Notice of the removal hearing must be published at least 7 days before the hearing and mailed at least 2 weeks prior to property owners listed in county tax records, with the removal resolution taking effect at the beginning of the next fiscal year.
