Requires cemetery operators and subsequent land purchasers to notify known family members at least 60 days before constructing any aboveground structure or building (including mausoleums or columbariums) within 10 feet of a belowground crypt or grave space.

Defines "family member" as persons entitled to inherit from the decedent under North Carolina's Intestate Succession Act (Chapter 29).

Notice must be sent by first-class mail to all known family members listed on interment records; if no family members are known, notice must be posted at the courthouse and construction site 60 days prior to construction.

Allows family members to request removal of the decedent's remains prior to construction or to seek temporary restraining orders and injunctions through the General Court of Justice in the county where the decedent is interred.

Effective October 1, 2013, and applies to all construction occurring on or after that date.
