Allows courts discretion to deny conditional discharge for first-time drug offenses, rather than mandatory discharge as previously required.

Applies to misdemeanor drug possession offenses under controlled substance schedules I-VI and drug paraphernalia charges, as well as felony possession under G.S. 90-95(a)(3).

Courts may only deny conditional discharge with a written finding and agreement from the District Attorney that the offender is inappropriate for discharge based on offense-related factors.

Effective December 1, 2013, and applies to offenses committed on or after that date.
