Eliminates the $5 million monetary threshold for expedited certificate of need review, allowing applications of any cost to qualify for expedited review if other conditions are met.

Increases the capital expenditure threshold triggering certificate of need review from $2 million to $4 million for new institutional health services.

Exempts replacement equipment from certificate of need review regardless of cost, eliminating the previous $2 million cost limit for replacement equipment.

Requires separate bond deposits for each approved certificate of need application subject to a contested case petition or appeal, with maximum bond amounts increased from $50,000 to $100,000 (and allows courts to set higher bonds without a specified cap for appeals).

Requires courts to award reasonable attorney's fees and costs to certificate of need applicants whose approved services are the subject of contested case petitions or appeals determined to be frivolous or filed to delay the applicant.
