H94 - Amend Environmental Laws 2013

• Repeal heavy-duty diesel vehicle emission requirements effective December 1, 2013, and direct the Department of Environment and Natural Resources to study continued need for vehicle emissions inspections by April 1, 2016.

• Provide air quality permit terms of eight years (except Title V permits limited to five years) and allow third parties to appeal Environmental Management Commission decisions on air quality and water quality permits within 30 days under the Administrative Procedure Act.

• Exempt agricultural ponds from riparian buffer protection rules and provide low-flow design alternatives for wastewater systems when professional engineer-sealed designs achieve lower flow rates than current standards.

• Combine the Division of Water Quality and Division of Water Resources into a new Division of Water Resources, and make clarifying changes to groundwater quality standards, stormwater definitions, and private drinking water well permitting procedures.

• Repeal the Mountain Resources Planning Act, allow local government development agreements for any-sized brownfields projects, exempt certain radio towers from military lands protection requirements, and require the Commission for Public Health to clarify smoking prohibition rules by January 1, 2014.
