S.L. 2013-384 (Senate Bill 151) Summary

• Removes requirement that at least one marine fisheries license agent be designated in each county containing or bordering coastal fishing waters, allowing the Secretary discretion in designating agents.

• Eliminates menhaden endorsement requirements for Standard Commercial Fishing Licenses, repealing provisions requiring endorsements and fees of $2.00 per ton of gross tonnage for purse seine operations.

• Revises terminal groin construction standards to allow structures designed to protect island termini from erosion and inlet migration, with prefilled sand and features allowing sand flow; requires environmental impact statements, inlet management plans with monitoring and mitigation requirements, and financial assurance through bonds or other instruments.

• Authorizes cities to adopt and enforce ordinances regulating activities on state ocean beaches within or adjacent to their jurisdictional boundaries, including placement of equipment and personal property, while preserving state regulatory authority and public trust rights.

• Section 3 provisions effective upon enactment for permit applications; remaining provisions effective when the act becomes law.
