Division of Health Service Regulation within the Department of Health and Human Services shall adopt rules governing requests for and release of pathological materials from clinical laboratories within its jurisdiction.

North Carolina Medical Board shall adopt rules governing requests for and release of pathological materials from clinical laboratories within its jurisdiction.

Both agencies' rules must be consistent with the North Carolina Hospital Association Best Practices Principles and the College of American Pathologists 2003 Professional Relations Manual.

Both agencies shall develop their rules in consultation with each other to ensure consistency in procedures governing pathological materials.

Act became effective upon ratification on April 30, 2013.
