SB 264 Summary

• Amends nuisance law to clarify that illegal possession or sale of controlled substances constitutes a nuisance even when not the sole purpose of a building or business.

• Allows nuisance actions to be brought against places or businesses that repeatedly engage in drug sales activities, enabling closure of repeat offenders.

• Establishes that buildings, vehicles, furniture, fixtures, and contents used in drug nuisances can be enjoined and abated.

• Exempts businesses regulated under Chapter 18B (alcoholic beverage regulation) from nuisance actions based solely on alcohol possession or sale violations.

• Effective upon enactment and applies to nuisance actions filed on or after the law's effective date (July 3, 2013).
