Allows entities regulated under Phase II of the National Pollutant Discharge Elimination System (NPDES) program to use the North Carolina Department of Transportation's Stormwater Best Management Practices Toolbox for linear transportation projects.

Adds new subsection (b1) to Section 9 of S.L. 2006-246, permitting permittees and regulated entities to fulfill post-construction stormwater management requirements for linear transportation projects, including private projects built to DOT standards that will be conveyed to the State.

Applies to projects that disturb one acre or more of land, including those disturbing less than one acre that are part of a larger common plan of development.

Became effective January 1, 2012.
